General Terms and Conditions (GT&Cs)

Zurich, 1. Oktober 2015
  1. Scope
    1. The following general terms and conditions (GT&Cs) are an integral part of every training course contract entered into as a result of enrolment on publicly advertised or customised training courses run by CONCEPT360.
    2. The GT&Cs that are valid at the time of enrolment shall apply and are available to view at
    3. Amendments and subsidiary agreements are only valid if they are agreed by both parties in writing. Special provisions and agreements for individual training courses shall take priority over these general terms and conditions (GT&Cs).
    4. Should any provision of this contract be or become invalid or should the contract contain any loophole, this shall not affect the legal validity of the remaining provisions. The invalid provision shall be replaced by a provision that comes as close as possible in its purpose to the invalid provision.
  2. Enrolment and course fees
    1. Course participants must enrol in writing – either online via the booking system or by email. Enrolment is binding.
    2. The number of places on each training course is limited. Applications for enrolment will be considered in the order in which they are received.
    3. Fees vary according to the course and are shown in the course descriptions. Figures quoted are per person in all cases.
    4. Once successfully enrolled, course participants will receive an invoice for the course fee, which is to be paid within ten days, but no later than two days before commencement of the training.
    5. Enrolment on a training course is only considered confirmed and binding once payment has been received by CONCEPT360 and confirmation of enrolment has been provided in writing (by email).
  3. Fees
    1. Course fees include classroom training and course materials but do not include travel costs, overnight accommodation, meals, literature, software and hardware, etc.
  4. Prerequisites
    1. The applicant profile and prior knowledge required are stated in the course description. It is the participant's responsibility to establish beforehand whether or not the course selected is appropriate for them.
    2. It is the participant's responsibility to comply with the technical prerequisites and bring with them the resources necessary for participation in the training course, such as a personal laptop or workstation. The associated costs are also to be borne by the participants.
    3. CONCEPT360 will provide test versions of software and examples of content.
    4. CONCEPT360 cannot be held responsible if a participant is unable to take part in a training course due to lack of equipment or as a result of technical problems.
  5. Provision of training
    1. CONCEPT360 guarantees that the training courses will be provided in a diligent fashion. It reserves the right to make modifications and adjustments to the training programme that do not significantly alter the learning objective or content.
    2. The organiser reserves the right to change training staff and make changes to the order and content of course components if necessary.
    3. Unless stated otherwise in the course description, training sessions are from
      9 am to 5 pm.
  6. Copyright and data protection
    1. Course participants undertake not to re-use, modify or divulge any personal or company-related information which they obtain from other course participants, training staff or third parties.
    2. Course participants and the course organiser undertake to comply with the principles of copyright law. Duplication of the learning materials is not permitted. It is also forbidden to inform third parties of their content. The organiser respects the copyright of participants with regard to their contributions and other work used in connection with the training course.
    3. The organiser undertakes to comply with the principles of data protection law and, in particular, not to pass on or sell information to third parties. The organiser will store information about course participants, such as residential address or email address and websites, in order to subsequently make information available to them regarding further training courses.
  7. Cancellation, postponement and termination of training courses
    1. If training staff are absent or other valid reasons apply, the organiser may postpone or cancel the training course, even if the course fees have already been paid. In such cases, the participants affected will be informed and if possible, offered an alternative. If this is not possible or the alternative suggestion is rejected by a participant who is affected, the advance payment will be refunded. Further claims are excluded.
    2. If a participant wishes to cancel their enrolment or terminate the course, they should inform CONCEPT360 of this by email. If a cancellation is received by CONCEPT360 later than two days before the start of the training course, a cancellation charge amounting to one third of the course fee will be made or only two thirds of the advance payment will be refunded.
  8. Liability
    1. Information given during the training courses is conveyed by training staff to the best of their knowledge and belief. The organiser is liable for any errors in the information, course materials or data carriers arising from intent or gross negligence. In such cases, CONCEPT360 is also liable for any losses or consequential losses arising therefrom.
    2. 8.2. Course participants are responsible for the content of their work. Any work that violates applicable law will be deleted.
  9. Applicable law and jurisdiction
    1. These general terms and conditions (GT&Cs) and the individual agreements regarding participation in training courses are governed by Swiss law and apply in Switzerland as well as in other countries, if this is expressly or tacitly acknowledged by the parties concerned.
    2. For all disputes arising in connection with these general terms and conditions (GT&Cs) concerning participation in training courses run by CONCEPT360, the exclusive place of jurisdiction is Zurich, Switzerland.
